Welcome to BOOKD (www.bookd.space), operated by BOOKD Technologies Pvt. Ltd. ("We", "Us", "Our"). These Terms of Service ("Terms") govern your use of our platform and services. By accessing or using BOOKD, you agree to these Terms and our Privacy Policy. Please read them carefully.

Interpretation and Definitions

Interpretation:

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

Definitions:

• Application: The services provided by BOOKD Technologies Pvt. Ltd., named "BOOKD" and also known as "Bookd Space" or "BookdSpace"
• Affiliate: An entity controlling, controlled by, or under common control with us.
• Country: India (Registered Office: New Delhi).
• Company: BOOKD Technologies Pvt. Ltd.
• Device: Any device that can access the Service, such as a smartphone, tablet, or computer.
• Service: The Application, Website, or both.
• Terms and Conditions: These Terms that form the entire agreement between You and the Company.
• Third-party Social Media Service: Services or content provided by third parties.
• Website: BOOKD, accessible at www.bookd.space.
• You: The individual, company, or other legal entity accessing the Service.

Acknowledgement

These Terms govern your use of the Service. Your use of the Service also constitutes acceptance of our Privacy Policy. If you do not agree to these Terms, you must not use our Service.

Role of BOOKD

BOOKD operates as a platform facilitating discovery and connection between Guests and Hosts. We handle booking transactions, process payments, and offer customer support throughout the experience.

Payments

All payments are securely processed through Razorpay, offering multiple options at checkout (select whichever is available at the time of service):

• UPI (Google Pay, PhonePe, BHIM, etc.)
• Credit & Debit Cards (Visa, Mastercard, RuPay, Amex)
• Net Banking (support for 50+ banks)
• Wallets (Paytm, MobiKwik, Airtel Money, Freecharge)
• EMI Options (Credit/Debit Card EMI, Cardless EMI)
• Pay Later Services (LazyPay, Simpl, ICICI PayLater, FlexiPay)

We offer convenient PayLater services and EMI options so you can manage your cash flow, even if project advances are pending.

Payment Timing:

• Guests are charged in full once a Host accepts the booking request.
• Until acceptance, the booking remains pending, and your payment is held securely with us, protected by our payment terms and conditions.

Host Payouts

• Host payouts are initiated within T+1 working days after the event/shoot.
• For multi-day bookings, payouts are processed after the final day.
• Hosts must share accurate direct bank and KYC details during the onboarding process.

Cancellations and Refunds

Cancellation and refund terms depend on the Host's selected policy, as clearly stated on the listing page. You can find full details by visiting our Cancellation & Refund Policy.

Communication

• Guests and Hosts are connected via WhatsApp for smooth communication after booking.
• Communication for scout visits or access coordination is allowed.
• Official cancellations and disputes must still be reported through email at support@bookd.space.

Overtime and Security Deposits

• Overtime charges and security deposits (if applicable) are governed by the terms stated in each Host's listing.
• Hosts manage their own deposit collection, handling, and refunds.
• Overtime charges must be settled before leaving the space with the host.

Disputes

• Disputes arising between Guests and Hosts must be resolved directly between the parties.
• BOOKD may assist in mediation but is not responsible for enforcement.
• Unresolved disputes may result in temporary account suspension until resolution.

User Responsibilities

All users (Guests and Hosts) must:

• Provide accurate information.
• Respect listed rules and policies.
• Communicate openly and in good faith.
• Maintain the integrity of the BOOKD community.

Violation of these responsibilities may result in penalties, suspension, or permanent removal.

Off-Platform Transactions and Limitation of Liability

All core transactions, including but not limited to bookings, payments, and booking-related communication, must be conducted and initiated solely via the BOOKD platform or its authorised operational and support team.

Any attempt to bypass the platform and enter into direct arrangements constitutes a breach of these Terms. However, Hosts are permitted to collect security deposits and overtime charges directly from Guests, as long as these charges are transparently listed on the platform or conveyed through official BOOKD communication channels, are acknowledged by the Guest prior to the shoot, and do not modify the base booking amount or violate any platform policies.

BOOKD disclaims all responsibility and legal liability for issues, damages, or disputes that arise from off-platform transactions, including but not limited to informal deals, direct payments, or private communications not initiated through or supported by BOOKD systems.

Users engaging in such activity forfeit access to platform protections, customer support, dispute resolution mechanisms, and refund eligibility or guarantees. Such violations may also result in account suspension or termination, denial of access to future platform services, and legal action under the Information Technology Act, 2000, for circumvention of digital systems and breach of platform integrity.

We strongly advise all users to adhere to platform protocols to ensure a transparent, accountable, and secure booking experience.

Intellectual Property and Confidentiality

Ownership of Intellectual Property

All materials, content, and functionalities made available on the BOOKD platform, including but not limited to text, code, photographs, illustrations, visual layouts, branding elements, logos, trademarks, audiovisual media, documents, communications, and software,are the intellectual property of BOOKD Technologies Pvt. Ltd. or its duly authorized licensors.

These are protected under applicable Indian laws, including The Copyright Act, 1957; The Trademarks Act, 1999; The Designs Act, 2000; The Patents Act, 1970; and The Information Technology Act, 2000.

No content from the BOOKD platform may be copied, modified, reproduced, transmitted, republished, uploaded, distributed, reverse engineered, or used to create derivative works, without explicit prior written consent from BOOKD Technologies Pvt. Ltd.

Confidentiality of Communications and Information

All past, present, and future communications, materials, and documents,whether written, verbal, visual, or digital, exchanged between BOOKD Technologies Pvt. Ltd. and any user, partner, vendor, consultant, service provider, or collaborator, are deemed strictly confidential unless expressly stated otherwise in writing.

Confidential information includes platform vision, product strategy, internal workflows, pricing structures, host and vendor onboarding materials, any documentation, emails, verbal discussions, or plans related to current or future features, business development communications or roadmap decks, and proprietary operational know-how, data systems, or partner outreach strategies.

Such information must not be disclosed, transmitted, or used for any unauthorized commercial, personal, or competitive purpose. Any unauthorized sharing or misuse constitutes a material breach of these Terms and may give rise to legal liability, including under The Indian Contract Act, 1872; The Information Technology Act, 2000; trade secrets protections under Indian common law; and Section 72 of the IT Act (for breach of confidentiality and privacy).

Prohibition on Competitive Use and Cloning

Users, vendors, collaborators, and third parties are strictly prohibited from using BOOKD's confidential information or platform knowledge, whether directly or indirectly, to create or contribute to a similar or competing service or platform.

Any form of imitation, system replication, UI/UX duplication, functional cloning, or reverse engineering of any part of the BOOKD product or business is expressly forbidden.

Enforcement of Rights

BOOKD Technologies Pvt. Ltd. reserves full rights to pursue legal action, civil and criminal, against any party found violating its intellectual property rights or breaching confidentiality obligations. This includes seeking injunctive relief, damages, or account suspension, as well as filing claims in accordance with the Indian legal framework and courts with jurisdiction in New Delhi, India.

As part of our limited-time promotion, BOOKD ("we", "us", "our") is offering a 15% discount on eligible bookings made through our platform (www.bookd.space). By participating in this promotion, users ("you") agree to the following Terms & Conditions:

Offer Scope

This promotion grants a flat 15% discount on the total booking amount for all verified listings available on BOOKD. The discount applies only to bookings made through the official BOOKD platform during the promotional period.

Eligibility Criteria

• The offer is valid exclusively for bookings of verified listings.
• Only direct platform bookings qualify. Bookings made off-platform or through third-party communications are excluded.

Offer Period

• The promotion is valid from Aug 22nd, 2025, to Sep 15th, 2025, inclusive.
• BOOKD reserves the right to change, suspend, or terminate this promotion at any time without notice or liability.

Redemption Process

• The discount is applied automatically at checkout when the designated coupon code is entered.
• The offer is non-transferable and cannot be redeemed for cash.
• The promotion cannot be combined with other discounts, promo codes, offers, or credits.

Scope of Discount

• The discount applies to the final booking amount, including any listed add-ons.
• Charges such as overtime fees, security deposits, or miscellaneous host-specific fees are excluded from the discount and must be settled directly with the host on the day of the booking, via the host's preferred payment method, refer to the specific on the listing page for the same.

Cancellations & Refunds

• Cancellations are subject to the individual listing's cancellation policy.
• In the event of a refund, only the discounted amount will be considered eligible. In the event that the host fails to confirm your booking, the reservation will be automatically canceled, and a full refund of the paid amount will be issued to you, which will reflect in your source account in 5-7 business days.
• Any refund of excluded fees (e.g., overtime, security deposit, etc.) must be handled directly with the host.

Fair Use & Abuse Prevention

• BOOKD retains the right to restrict, revoke, or suspend promotional access in cases of suspected fraud, abuse, or misuse.
• Decision to restrict use is at BOOKD's sole discretion and not subject to appeal.

Limitation of Liability

BOOKD is not liable for any damages, losses, or disruptions caused by use or misuse of this promotion. Use of this offer constitutes acceptance of these terms and of BOOKD's general Terms of Service.

Governing Law pertaining to the "SAVE 15% OFF on everything" offer

These terms shall be governed by and construed in accordance with the laws of India. All disputes arising out of or in connection with this promotion shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.

Changes to Terms

We may update these Terms at any time. Updates become effective once posted. Continued use of the Service constitutes acceptance of the updated Terms.
